Code of Ethics

As an IECC Certified Equity Centered spirituality and business coach, mentor and educator, I am committed to upholding the utmost ethical code of conduct in my practice for myself, my clients and Spirit. When working with me, you can rest assured that these ethics and a level of high integrity are woven into all that I do.

  • I will never knowingly perform spiritual or intuitive coaching for anyone unless permission is granted directly from them.
  • I accept that the coaching I provide is not a substitute for medical services or counseling with a designated professional. I do not give medical advice during my sessions. Should you need medical advice, please contact a medical professional.
  • I will never conduct coaching under the influence of alcohol or mind-altering illegal drugs.
  • I ask that clients show up to calls in a sober state, and not under the influence of any substance that might impact their ability to make clear, empowered choices. 
  • I will always have my client’s best interest at the forefront of everything I do. Together, we will co-create a program that works for the client.
  • I will act from a place of highest integrity when working with my clients and students. If there is ever a time where I feel too ill or distracted to offer a session or a class, I will reschedule or offer a full refund for that session for not being able to continue.
  • I will never use any threatening language to clients, about clients, or share information that may suggest fearful experiences or harmful behavior. This includes the language I use around topics that could include implications to lifestyle or life.
  • I will remind my clients that we all have free will. This means that energy is flexible and ever-changing and can shift based on the choices the client makes.
  • I promise to continue my education, spiritual and business studies, so that I can continue to grow and support my clients. This commitment to education allows me to continue to offer my best self for our  sessions together.
  • I will never tell a client what to do in relation to their life’s choices. All choices a client makes are their own personal responsibility. Each client has free will to choose which direction in life they want to take.

We have taken the necessary steps to ensure that we are in compliance with the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act of 2003 and will not send misleading information, and will promptly honor opt out requests within 10 business days.

  • Subscribe to our newsletter by completing the double opt-in wherein you initiate a request to join our newsletter, and confirm your subscription via the email delivered to the address you provided. You may unsubscribe at any time. Being a newsletter subscriber is a requirement to receive certain emails from us, including but not limited to: free offerings, free challenge and event sign-ups, and  quiz results.

We automatically collect personal information when you:

  • Visit, interact with, or use our Website;
  • Access, use, or download content from us; and
  • Open emails or click links in emails from us;
  • Purchase or signup for a product, service or offering.

Passwords

Certain features of our Website require the creation of a username and password. You are responsible for keeping your username and password confidential. If you receive an email from us that appears to be a request for personal information, do not respond because it may be a phishing scam designed to steal your personal information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. 

Should there be a data breach, we will notify you when we are legally required to do so.

Dispute Resolution and Jurisdiction 

These Terms and Conditions shall be governed and construed according to the laws of the State of North Carolina, without regard to conflict of laws principles. The nearest state and federal court to Duck, North Carolina shall have exclusive jurisdiction over any case or controversy arising from your use of our website or its content, or via materials requested through email.

By using our Website or its content, or via materials requested through email, you submit to the exclusive jurisdiction and venue of these courts and waive any defense of forum non conveniens.

In the event that Jessica Paschke – Intuitive by the Sea, LLC must make a claim for any breach of these Terms and Conditions by negotiation, litigation, mediation, or arbitration, we shall be entitled to recover attorney’s fees and costs. 

Severability

If any provision of these Terms and Conditions shall be declared unenforceable or invalid, all remaining provisions shall remain in full force and effect. 

Modification

We reserve the right, in our sole discretion, to change, modify, add, or delete portions of these Terms and Conditions at any time without notice, and it is your responsibility to review these Terms and Conditions for any changes. Such changes are effective immediately upon us posting the revised Terms and Conditions. Your use of the Website following any change(s) to these Terms and Conditions will constitute your agreement and acceptance of the revised Terms and Conditions.

We recommend that you check the Terms and Conditions when you visit our Website to be sure that you are aware of our most current policies.

Terms of Service

These Terms of Service apply to all services provided by Jessica Paschke – Intuitive by the Sea, LLC (hereinafter “we,” “our,” “us”) unless superseded by a separate agreement.

Policy on Cancellations, Missed Appointments, and Refunds

Appointments may be booked by using the embedded scheduler or using a direct link provided us. Upon scheduling, clients will receive a confirmation email with the details of the appointment, and a link to remit payment if the session was manually scheduled by us. Payment for manually scheduled appointments is due upon receipt of the confirmation email, and sessions may be canceled if not received within 48 hours.

Clients may change or cancel an existing appointment from the links in the confirmation email, or by contacting us directly as soon as an appointment must be changed. We maintain a strict 24 hour change/cancellation policy. Clients will not be changed for confirmed changes or cancellations more than 24 hours in advance. Clients who miss appointments and/or are greater than 10 minutes late may forfeit appointments at our discretion and may not be refunded the scheduled session rate.

All appointments are scheduled in EASTERN STANDARD TIME (EST). Clients are solely responsible for selecting the correct time zone when scheduling an appointment and ensuring they are available at the scheduled time. Missing a scheduled appointment forfeits the appointment, and clients may not be refunded the scheduled session rate. Check your local timezone here.

Clients are expected to contact us at their own cost through the agreed upon method (e.g. in-person, telephone, video conference, voxer app, etc.). It is the client’s responsibility to ensure that the contact information given at the time of booking is correct.

Jessica Paschke – Intuitive by the Sea, LLC reserves the right to refuse a session request.

Policy on Refunds for Courses, Intensives, Masterclasses, and Workshops

Clients may request a refund for a multi-week course, intensive, or masterclass no later than the seven days after the course start date by contacting support@intuitivebythesea.com. Clients on payment plans will receive a notification of failed or missed payments, and be given 48 hours to remit a missed payment before their access to the course, materials, and/or interactive groups will be suspended. Reinstatement will be at the sole discretion of Jessica Paschke – Intuitive by the Sea, LLC upon receipt of payments due.

For a paid workshop or event less than seven days in duration, there will be no refunds.

Personal Conduct in Group Settings

Due to the sensitive nature of group coaching and/or class settings, clients who fail to adhere to posted or communicated personal conduct guidelines or who are disruptive to the learning experience of other attendees will be counseled, warned, and/or removed at the sole discretion of Jessica Paschke – Intuitive by the Sea, LLC. Refunds for violating personal conduct guidelines will be evaluated on a case by case basis and may be granted at the sole discretion of Jessica Paschke – Intuitive by the Sea, LLC.

We reserves the right to refuse attendance to a course, intensives, masterclasses, workshops, or other events.

Gift Certificates, Coupons, Discounts and Promotions

All gift certificates, coupons, discounts and specials are subject to the terms listed in the item description, promotion email, or advertisement, as applicable. If you have any questions about a gift certificate, coupon, discount or special, contact support@intuitivebythesea.com prior to purchase.

In general, unless otherwise specified, the following apply:

  • Gift Certificates for One-on-One Sessions in person, by phone, or via video chat must be completed within one (1) year from the date of purchase.
  • Gift Certificates purchases are final and non-refundable, but may be transferred to another recipient. Contact support@intuitivebythesea.com to change the recipient of a gift certificate.

Payment Processing and Refunds

Jessica Paschke – Intuitive by the Sea, LLC uses secure third-party processors to accept payment. These include Squareup, PayPal and others. Due to recent policy changes by these third-party providers, when a refund is issued by us the refund will be processed in the amount of the initial charge less any fees levied by the payment processor. These fees are strictly limited to those imposed by the payment processor. If you have any questions, please contact support@intuitivebythesea.com prior to purchase.

Order Confirmation and Payment Details

We will email you to confirm the placement of your order and with details concerning your purchase. In the event there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.

Recurring Payments

All memberships and some services are set up as an ongoing and recurring subscription or recurring payments over time. The credit card information you provide at time of check out will be charged in accordance with the membership type that you purchase. All charges are in USD.

Our Memberships and Communities generally offer the following payment plans: 

Monthly Membership: A monthly membership is valid for 30 days from the date you join the membership (your anniversary date). Your credit card will be charged each month on your anniversary date until such time as your membership is terminated by you or us.

Annual Membership: An annual membership is valid for 365 days from the date you join the membership (your anniversary date). Your credit card will be charged each year on your anniversary date until such time as your membership is terminated by you or us. 

We reserve the right to discontinue a membership offered by Jessica Paschke – Intuitive by the Sea, LLC at any time for any reason. 

You understand and agree that you are financially responsible for all purchases made by you or a third-party acting on your behalf. You understand and agree that your failure to pay any outstanding balance due does not cancel your obligation to pay said amount (including any surcharge for any failed payment), whether or not you remain an active member.

If payment cannot be charged to your credit card or your charge is returned for any reason, including chargeback, we reserve the right to either suspend or terminate your access to the membership, thereby terminating the membership terms of use and all obligations of ours hereunder.

If you have reason to believe that your membership account is no longer secure (for example, in the event of a loss, theft or unauthorized disclosure or use of your ID, password, or any credit, debit, or charge card number stored), notify us of the problem to avoid possible liability for any unauthorized charges to your account.

It is your responsibility to notify us if your credit card has changed or has expired and to make appropriate changes or your access and account may either be suspended or terminated.

We reserve the right to refer collection of the outstanding balance to an attorney or collections agency. If your outstanding balance is referred to an attorney or collections agency, you shall pay all reasonable attorney’s fees or collections agency fees.

All of the personal information that you provide as part of the purchase process for a membership offered by Jessica Paschke – Intuitive by the Sea, LLC may be collected by both us and our third-party payment processing providers. This includes, but is not limited to, name, email address, billing information, and credit card number. Please read our Privacy Policy (above) with respect to how we handle your personal information.

Our third-party payment processing providers may have privacy policies and terms and conditions that differ from ours. We have no liability or responsibility for the independent policies of our third-party payment processing providers. You are encouraged to read the independent policies contained on the third-party payment processing providers’ websites.

You understand and release us from liability for any damage or loss caused by your purchase of any membership offered by Jessica Paschke – Intuitive by the Sea, LLC or by your dealings with our third-party payment processing providers.

Refunds

Due to the extensive time and effort that goes into our offerings, services, and memberships, we have a blanket no refund policy. If you are not 100% satisfied with your purchase of our offerings, services, and/or memberships, you have 3 calendar days from the date the initial fee was charged to request a refund, unless specified differently in other sections of these terms.

The only way to request a refund is by notifying us in writing via email at: support@intuitivebythesea.com 

Upon determining that you are entitled to a refund pursuant to these Terms of Use, we will promptly issue an instruction to our third-party payment processor to issue the refund. We do not control our third-party payment processor and will not be able to expedite refunds.

Generally, we will not provide refunds more than 3 calendar days from the date of purchase. After that timeframe, all payments are non-refundable.

If you pay by credit card, and seek a refund of funds, your refund will be reduced by any applicable credit card charges that are assessed against us.  Credit card charges are estimated and will be charged based on what we are charged by the credit card processor.

We do not tolerate or accept any type of chargeback from your credit card company. Please reach to support@intuitivebythesea.com before you dispute a transaction with your card issuer or bank.
